Barring People from Campus Procedures

The GW Police Department (GWPD) may issue a Barring Notice to GW Community Members or Non-University Affiliates verbally or in writing at the time of the concerning conduct or at the request of an individual or university office, as described below. Promptly following or concurrently with its issuance, a written notification will be sent to the barred individual via email, first-class mail, and/or certified mail. A written Barring Notice will inform the barred person of the following:

  • That they are barred from all GW-owned, controlled, or leased property or parts of GW-controlled, owned, or leased property (specifying the portion, if applicable). 
  • The reason for the barring. 
  • That if they return to GW-owned, controlled, or leased property, they are subject to arrest for criminal trespass. 
  • The Barring Notice is effective immediately.  
  • Information regarding how to appeal the Barring Notice.

GW Community Members

GWPD can issue a Barring Notice to GW Community Members for any of the following reasons:

  1. Conduct where there is evidence that the continued presence of the individual(s) poses a threat to any person or to the stability of university operations. 
  2. Enforcement of Temporary and Immediate Suspension status, Emergency Removal, and/or administrative leave (collectively, “Interim Action”) pending the outcome of a university process, provided that a university office, such as Conflict Education and Student Accountability (CESA), the Title IX Office, Human Resource Management and Development (HRMD), and/or Faculty Affairs has determined that the standard for such Interim Action, as applicable, has been met. 
  3. Enforcement of disciplinary outcomes or findings of responsibility through a university process overseen by CESA, Title IX Office, HRMD, or Faculty Affairs, as applicable. 
  4. Through a mutual agreement between parties as part of the Title IX Negotiated Resolution Process, CESA’s Alternative Resolution Process, or Equal Employment Opportunity and Access’ Informal Resolution Process (within HRMD) which may be issued for a set period of time as agreed upon between all involved parties and the university.  

If a Barring Notice is issued to a GW Community Member and subsequent Interim Action taken is modified or revoked, or a disciplinary process at the university determines that the individual is not responsible for the original behavior for which the Barring Notice was issued, the Barring Notice shall be revoked in coordination with the relevant office and GWPD. 

When issuing Barring Notices to Students:

  • Barring Notices issued to enrolled, unenrolled, or suspended students can impact enrollment, return, or admission. As such, GWPD shall, when able, consult with leaders in the Division for Student Affairs and/or the Title IX Office prior to issuance of a Barring Notice. In incidents where an emergent need necessitates a Barring Notice without an ability to consult with the above leaders, GWPD shall, within 24 business hours, consult with the above-listed leaders to consider the circumstance under which the Barring Notice was issued and to determine whether additional actions need to be taken under disciplinary or other governing university processes. 

  • Enrolled students who are issued Barring Notices shall be considered for Interim Action by the Division for Student Affairs in accordance with the Code of Student Conduct or the Title IX Office in accordance with Title IX Sexual Harassment & Related Conduct Policy as applicable.  

  • Students living in residence halls who are issued Barring Notices will have their room and building access revoked pending review by the Division for Student Affairs and/or the Title IX Office, as described above. The Division for Student Affairs and GWPD will standby and have access to the room as the student vacates. Contraband and evidence will be handled in accordance with existing law, and under the control of GWPD. 

  • Appeals surrounding a Barring Notice for enrolled students should be submitted in accordance with the procedures outlined in the relevant university process (i.e. the Code of Student Conduct or the Title IX Sexual Harassment and Related Conduct Policy) and will be reviewed collaboratively by the Associate Vice President for Safety and the Vice Provost for Student Affairs, or the Assistant Provost and University Title IX Coordinator, or their designee(s), as applicable.  

When issuing Barring Notices to Employees (Faculty and Staff):

  • Employees who are issued Barring Notices will be placed on paid or unpaid administrative leave or terminated. In these cases, GWPD shall consult with the Title IX Office, Faculty Affairs, and/or HRMD as applicable within 24 business hours of issuing the Barring Notice depending on the affiliation of the employee. An employee’s office or workspace can be accessed by GWPD, Division Safety and Operations officials, and other management or supervisory personnel as appropriate. Discovered contraband and evidence will be handled in accordance with existing law and under the control of GWPD. 

  • Appeals surrounding a Barring Notice for employees should be submitted in accordance with the procedures outlined in the relevant university process and will be reviewed collaboratively by the Associate Vice President for Campus Safety and the Vice President and Chief People Officer, or the Vice Provost for Faculty Affairs, or their designee(s), as applicable. 

Non-University Affiliates 

GWPD can issue a Barring Notice to Non-University Affiliates for any of the following reasons: 

  1. The commission of or upon conviction of any criminal activity occurring on or off university-owned, controlled, or leased property. 
  2. A violation of a university policy. 
  3. The failure to adhere to a directive of a police officer or university official. 
  4. Conduct where there is evidence that the continued presence of the individual(s) poses a threat to any person or to the stability of university operations. 
  5. The provision of supportive measures per the Title IX Sexual Harassment and Related Conduct Policy. 

When issuing a Barring Notice to Non-University Affiliates, should GWPD become aware the individual(s) are involved in a university process, GWPD will notify the relevant office(s). 

Appealing a Barring Notice

Barring Notices issued to GW Community Members are typically issued in conjunction with disciplinary action for the alleged behavior for which the Barring Notice is issued. Therefore, the Barring Notice will stay in effect pending the outcome of the relevant university process.  

If a Non-University Affiliate wishes to appeal the issuance of a Barring Notice, they must submit to the Associate Vice President for Campus Safety within five business days of issuance of the Barring Notice in writing or via email at gwpdatgwu [dot] edu (gwpd[at]gwu[dot]edu). Appeals should include the following:

  • Appellant’s contact information, including address, telephone number, and e-mail address. 

  • Date of the issuance of the Barring Notice. 

  • The reason for the review request. 

  • A complete explanation for the conduct that precipitated the Barring Notice. 

  • The basis for the desire to be on GW-controlled, owned, or leased property.

  • Any other information the appellant wishes to be considered. 

The Associate Vice President for Campus Safety shall issue the decision upholding, modifying, or withdrawing the Barring Notice within twenty-one (21) calendar days after receipt of the written appeal. This decision shall be final and conclusive. 

All Barring Notices, whether affiliated with the university or not, will remain in effect while an appeal is being considered, unless GWPD modifies or withdraws the Barring Notice. 

Revocation of a Barring Notice

As mentioned above, Barring Notices issued to GW Community Members are typically issued in conjunction with disciplinary action for the alleged behavior for which the Barring Notice is issued, and as such, the conditions of the Barring Notice will be in effect concurrent with the length of time stated as the result of a university process (e.g., if a student is suspended for one year as the result of being found responsible for a violation of the Code of Student Conduct, the Barring Notice will be effective for the same length of time).  

Six months after the issuance of a Barring Notice, a Non-University Affiliate may submit a petition to have the Barring Notice revoked no more than two times per year to the Associate Vice President for Campus Safety. Applications can be submitted to gwpdatgwu [dot] edu (gwpd[at]gwu[dot]edu) and should include the following:

  • New or relevant information indicating the rationale for revocation of the Barring Notice.

  • Date of issuance of the Barring Notice. 

  • The basis for the desire to be on GW-controlled, owned, or leased property. 

  • Any other information the individual wishes to be considered. 

Barring Notices will remain in effect until a revocation request is approved.  

Requesting a Barring Notice

Any person may request a Barring Notice by meeting with a representative of GWPD. Additionally, university offices, including but not limited to the Title IX Office, CESA, HRMD, and the Office of Advocacy and Support may submit a written request for a Barring Notice on behalf of a GW community member and/or the university. GWPD aims to provide a response to the requestor within 72 hours indicating whether or not the Barring Notice will be issued. A request should include the following: 

  • Name, phone number, residence or work location, and email address of the requestor and the subject of the barring request, as available. (A requestor or subject that does not have a permanent residence may still be considered for a Barring Notice.) 
  • Which of the above-listed reasons is the basis for requesting the Barring Notice. 
  • Any additional information or documentation that would inform the determination of necessity for the Barring Notice.
